Please refer to your
Letter dated 20/04/2018, pertaining to the subject mentioned herein above. In these
regards, Cuncolim Municipal Council. in exercise of powers conferred on me by virtue
of sub-section l (b to d) of Section 59 and sub-section (l) of Section 51 of
Goa Municipalities Act, 1968, hereby gives us approval! consent to establish Fish
Meal Processing (Non-polluting) Unit in Cuncolim Industrial Estate at Cuncolim,
Salcete-Goa.
From the documentary evidence, It is revealed
that the proposed site for setting up of the unit falls within the area earrmarked
for Cuncolim Industrial Estate, governed by GOA-IDC, vide Govt. Gazette Notification
No 15 M 92-IND dated 20-02-2001, published in the Oft‘lcial Gazette, Sens
I No. 47. dated 22-02-2001.
Further Resolution No.
10-C, not to allow permission to set up new Fish meals plants and other polluted
factories. was rejected. cancelled and revoked by the majority Councillors of
Cuncolim Municipal Council in the ordinary Meeting held on 23/06/2017, since
the same was not discussed m the previous meeting held on 07/04/2017.
In view of the above
facts, Cuncolim Municipal Council. hereby gives then NO OBJECTION in favour of
M/s VIVA MARINE lMPEX for setting up of Fish-Meal Processing (a Non-polluting)
Unit in Cuncolim Municipal Council at Cuncolim-Goa. subject to other approvals
from concerned authorities.

rejected our proposal to setup Fishmeal Processing Unit Cuncolim Industrial
estate citing reasons of Objectlon from the Cuncolim Municipal Council.
We applied to Cuncolim
Municipal Council along with a copy of your letter referred above for their approval/Consent
to establish Fishmeal Processing (Non polluting ) unit at Cuncolim Industrial
estate
We are happy to inform
you that the Cuncolim Municipal Council has communicated Approval/ Consent to
Setup Fishmeal Processing (Non-polluting unit in Unit Cuncolim Industrial
estate wide their letter No CMC 2018 19/192 dated 24/04/2018 we are attachinig a
self attested copy of the above mentioned N0C for your kind perusal.
In the light of the
above mentioned NOC, we kindly request you to reconsider our proposal for in
principal approval for allotment of 9000 sq mtrs land Cuncolim Industrial

Reference the subject matter with the Cuncolim Municipal
Council letter Ret. No. CMC-2018-19/192 dated
24-4-2018 we the undersigned councilors d the Cuncolim Municipal Council
submit that the NOC issued by the Cuncolim Municipal Council is illegal and
issued without taking us into confidence.
It is submitted that no resolution was ever taken to issue
such certificate and was never discussed among us not approved by us.
It is further submitted that this noc be made null and
void since the Chairperson is neither authorized not have any powers to sign or
issue such certificate/s.
